Applicant apprehends arrest in Crime No.263/2018, registered with Shivaji Nagar Police Station, Beed, for offence punishable under sections 420, 406, 409, 467, 120-B r/w 34 of the Indian Penal Code and sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

FIR is lodged on 16/04/2018 by Ramdhan Jagannath Tambade, alleging that one Parivartan Urban Multi-state Cooperative Credit Society Limited, Majalgaon, District Beed, had started it's branch at Beed and they gave assurance of handsome returns on fixed deposits. Managing Committee Members and the employees of the said society have deceived depositors for Rs. 3,28,69,196/-.

Heard learned advocate for applicant and learned Additional Public Prosecutor for State. Perused the investigation papers.

Charge-sheet is filed in the present crime in the month of January, 2019 and the case is numbered as Special Case (MPID) No.01/2019. There are 22 accused persons named in the chargesheet. 5.

Applicant is one of the Directors of the said society. Nothing is to be recovered from applicant and in view of filing of the charge-sheet, pre-trial custodial detention of the applicant in the facts of the present case is not necessary.

Learned Additional Public Prosecutor submits that forensic audit of the said society is going on and if any material is found then the prosecution be granted liberty to move application for cancellation of anticipatory bail. The said liberty is always there with the prosecution.

In the result, application is allowed.

In the event of arrest of applicant in Crime No.263/2018, registered with Shivaji Nagar Police Station, Beed, for offence punishable under sections 420, 406, 409, 467, 120-B r/w 34 of the Indian Penal Code and sections 3 and 4 of the
