Order :-

1. Mr. Deshmukh, learned counsel for petitioner states that petitioner has filed application before the Assistant Charity Commissioner (Exhibit-D), however, the same is not decided as yet. 2.

Learned counsel for respondent No. 2 states that Assistant Charity Commissioner does not have any jurisdiction to decide said application.

It is for the Assistant Charity Commissioner to take decision upon said application on its own merits considering all relevant aspects of the matter.

In view of the fact that representation/application (Exhibit-D) of the petitioner is pending with Assistant Charity Commissioner, the

2 WP-10063.13 Assistant Charity Commissioner shall decide the same on its merits and in accordance with law, if it is not already decided, as expeditiously as possible, preferably within a period of (09) nine months from the date of order. All the contentions of respective parties are kept open. 5.

With aforesaid direction, writ petition stands disposed of. No costs.
