Heard learned advocate for applicants. Perused the record and proceeding. The present C.A. has been preferred by the applicants for deleting the name of respondent no.11 Mankarnabai Eknath on the ground that the legal heirs of deceased respondent no.11 is already brought on record, who is respondent no.12. Thus, it is claimed that the name of respondent no.11 be permitted to be deleted from the array of respondent. Considering the ground mentioned in the C.A. And the claim made by the applicant, I am inclined to pass following order. C.A. Is allowed. Name of respondent no.11 Mankarnabai Eknath be deleted from the array of respondent. Necessary correction be made in memo of appeal.
