Heard learned advocate for applicants. Perused the record and proceeding. The applicants are praying for deleting the name of deceased respondent no.6 Annapurnabai Bhanudas, who is reported to be dead. It is the contention of the applicants that the respondent nos.7 to 10 are the legal heirs of deceased respondent no.6 and thus the respondent no.6 is represented by the respondent nos.7 to 10. Thus, it is claimed that the name of respondent no.6 permitted to be deleted from the array of respondent. Taking into consideration the ground assigned and the legal heirs of deceased respondent no.6 are already brought on record with respondent nos.7 to 10, I find no difficulty to pass following order.

Name of respondent no.6 Annapurnabai Bhanudas stands deleted from the array of respondent. Accordingly, C.A. Is allowed. Necessary correction be made in memo of appeal. REGISTRAR (JUDL) cnd.ca13271.14
