Heard learned Advocate Mr. Jangale h/f. learned Advocate Mr. R.R. Karpe for the applicant. He submits that during the Trial the applicant was on bail. The applicant has deposited fine amount. The maximum sentence awarded is of two years and to pay fine of Rs.1000/-. He submits that already the sentence is suspended till appeal period is over by the Trial Court on the date of judgment itself and he prays for suspension of sentence. 02.

Heard learned APP for the respondent/State.

Considering the submissions, this Court finds that the sentence is a short sentence. The matter is not likely to come up for hearing in near future and since the applicant is already protected, the sentence is suspended. Hence, following order:-

The substantive sentence awarded by the learned Additional Sessions Judge, Shrigonda by judgment and order dated 16.11.2022 in Sessions Case No.139 of 2019 is hereby suspended. 05.

The applicant to furnish same bail, fresh bond before the Trial Court.

The application is disposed off.
