Manik Maroti Vakse v. The State Of Maharashtra Through The Secretary And Others
- 1 -
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.12082 OF 2022 MANIK MAROTI VAKSE
VERSUS
THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND OTHERS Mr.M.L.Dharashive, Advocate for the petitioner. Mr.P.S.Patil, AGP for the respondent/State.
( CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.) DATE : DECEMBER 19, 2022 PER COURT :
1.
The petitioner, a 69 years old male, claims to be the husband of late Malanbai Manik. Her Unique Identification Card (Aadhar Card) indicates the birth year as 1958. She has passed away on 27.04.2021, allegedly due to Covid at the age of 63 years. The Sarpanch has issued a certificate in his private capacity dated 07.10.2021 claiming that the late Malanbai was doing such works as were suggested by the State Government during the Covid Period and she died on being infected by the Corona Virus.
- 2 - 2.
The GR dated 29.05.2020 pertains to granting monetary compensation to those who were front warriors performing the duties for the Government and Government Agencies during the Covid period. They were granted insurance cover with entitlement of ex-gratia monetary benefits.
3.
We fail to gather as to how a 63 years old lady could be an Aanganwadi Madatnis. When called for, the petitioner submits that he does not have any appointment order of his deceased wife. 4.
The learned AGP draws our attention to the communication dated 27.10.2022 and 07.11.2022 addressed by the Integrated Child Development Scheme, which is not arrayed as a respondent, asking the petitioner to tender certain documents so that an appropriate enquiry could be conducted into the genuineness of the claim of the petitioner. Instead of supplying the documents, the petitioner has rushed to this Court.
5.
We feel that the petitioner can be granted an opportunity to tender documents before the concerned authorities to substantiate his
- 3 - claim and, therefore, this petition is disposed off. Needless to state, the petitioner may reply to the call by the ICDS Authority and tender documents so as to prove the genuineness of his claim. The authorities concerned shall not take this matter lightly and shall make a serious inquiry into the matter while considering the claim of the petitioner. ( SANJAY A. DESHMUKH, J. ) ( RAVINDRA V. GHUGE, J.)
