By virtue of an order dated 20th September, 2025, Mr Darkunde, Police Head Constable, executed the NBW on the appellant, produced him before the Court, and accordingly filed a report. The same is taken on record and marked 'X' for identification purposes. The appellant has no complaint about any illegal treatment at the hands of the police. The appellant is taken into M. C. R.

Mr. Palnitkar, learned counsel for the appellant, seeks oral permission to obtain the signature of the appellant on the Vakalatnama. Permission is granted.

Mr. Palnitkar, learned counsel for the appellant, tenders across the bar an application for releasing the appellant on bail till disposal of the 1 / 2
16-APEAL-700-05.odt appeal, to which learned A.P.P. did not object. The said application is taken on record, and the same is to be registered accordingly. 4.
Learned counsel for the appellant/applicant submitted that due to miscommunication between the appellant/applicant and his earlier advocate, neither he nor his earlier advocate remained present before the Court. He further submitted that he would now attend court. Therefore, he urged the release of the appellant/applicant on bail.

It appears from the record that vide order dated 09th December, 2005, the applicant was released on bail on executing P.B. and S.B. of Rs. 10,000/- (Rupees Ten Thousand) with one surety. Having considered the facts of the case and reasons disclosed in the application, in my view, it would be appropriate to release the applicant on bail. 6.
Consequently, the criminal application is allowed. The applicant be released on furnishing P.B. and S.B. of Rs . 1,00,000/- (Rupees One Lakh) with one or two solvent sureties, before the learned trial Court within two weeks, till the disposal of the appeal. At the request of learned counsel for the applicant, the applicant be released on bail for a period of two weeks on furnishing P.B. of Rs. 1,00,000/- before the Registrar (Judicial) of this Court. 7.
List the appeal on 03rd November, 2025.
