Here is an application for regular bail in Crime No. I-208 of 2015 registered at Shillegaon Police Station, Tq. Gangapur, Dist. Aurangabad for the offences punishable under Sections 304(B), 498-A, 323, 504, 506 read with 34 of the Indian Penal Code.

Heard Mr C. R. Thorat, learned Advocate for applicant and Mr U. S. Mote, learned APP for respondent/State assisted by Mr Kawade, learned Advocate. Perused papers of investigation. 3.

It is the case of prosecution that Sonali daughter of complainant Baban Shyamrao Lagad resident of Debhegaon, Tq. Kannad, Dist. Aurangabad was married to Walmik Sudam Dube on 14.02.2013 as per customary rites. It is alleged that Sonali was ill-treated by her husband, parents-in-law and other members in the family on demand of dowry of Rs. 40,000/-. 4.

Then Sonali was missing from the house and on 21.10.2015 her dead body was found floating in a well near the house of Police Patil. Report was lodged by father on the basis of which above said crime came to be registered against the applicant and others.

Applicant is sister-in-law of Sonali. She was married to Appasaheb Padol resident of Zodegaon, Tq. Gangapur in the year 2010. Since marriage she is residing in her matrimonial house.

Allegations regarding alleged ill-treatment on demand of dowry at the hands of applicant are vague. No specific role is attributed to the applicant. That being so this Court finds it fit to enlarge the applicant on bail. Hence the following order.

ORDER

(i) Criminal Application No. 6109 of 2015 is allowed. (ii) Applicant Surekha Appasaheb Padol is released on bail in Crime No. I-208 of 2015 registered at Shillegaon Police Station, Tq. Gangapur, Dist. Aurangabad for the offences punishable under Sections 304(B), 498-A, 323, 504, 506 read with 34 of the Indian Penal Code on her furnishing PR and SB of Rs. 15,000/- (Rupees Twenty Five Thousand) each.

(iii) Applicant shall not tamper with the prosecution evidence and shall make herself available as and when required by the Investigating Agency.

(iv) Bail before the trial Court.
