Heard the learned counsel for the applicant and the learned APP for the respondent-State.

It is the case of love affair. It has been alleged that the applicant did sex with the prosecutrix under the promise to marry her. But, he married to another girl. The prosecutrix was 23 years old. Her parents were opposing her affair with the applicant. Her parents also drove her out from their house. Hence, she was living in Mahila Sudhar Gruha.

3. Considering the nature of allegations levelled against the applicant and completion of the investigation, there appears no propriety in keeping the applicant behind bars. Hence, the following order :

(i) Bail Application is allowed.

(ii) Applicant HANMANT ASHOK WAGHMARE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.137 of 2022, registered by Police Station Mukramabad, District Nanded, for the offence punishable under Sections 376, 376(2)(n), 417 of the IPC, on the condition not tamper with the prosecution witnesses.
