Heard the learned counsel for the applicant and the learned A.P.P for the respondent-State.

Perused the papers and statements of various witnesses. It appears that on the date of incident a Juice center run by the present applicant and deceased, was burnt. The applicant sought the help of the neighbourers. Few neihgbours helped him. One of the witnesses who noticed the deceased was injured in the home, immediately lodged the report. The applicant also went to the police station with him. He was all the while present with the police while drawing inquest panchnama and spot panchnama. The allegation against him is that he was threatening the

927- B.A. No. 1972-2022.odt deceased for money and deceased was expressing apprehension of danger at his hands. Subsequent to registering of the crime against the applicant a petrol bottle was seized from the Juice center of which the spot panchnama was drawn earlier to the arrest of the applicant. 3.

After having gone through the record, it appears that there is balancing evidence in favour of the prosecution. However, considering the conduct of the applicant, he has a good case on merit. Hence, the following order :-

ORDER

(i) The bail Application is allowed.

(ii) Applicant Rajeshkumar @ Rajesh Narayan Meghwanshi, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety of the like amount, in Crime No. 68/2022, registered with Goregaon Police Station District Hingoli for the ofences punishable under Sections 302, 201 of the Indian Penal Code on the conditions that (a) He shall not tamper with the prosecution witnesses. (b) He shall not leave the jurisdiction of Goregaon Police Station, District Hingoli, without the leave of the police, till the conclusion of the trial.
