applicants and learned APP for the State.

The applicants have been arraigned as accused for an offence of murder. The prosecution case rests upon the circumstantial evidence. Bail has been claimed on parity. The similarly situated co-accused have been released by this Court by order dated 1st August, 2022 in Bail Application No.732/2022 and Bail Application No.1305/2022 dated 15th September, 2022.

There is no dispute about the similar role attributed to the applicants with the coaccused, who have been released on bail. That apart, nothing is to be recovered from the applicants. Considering the role attributed to the applicants with the role attributed to the co-accused, who have been granted bail, the parity may be extended. Hence the order :-
ORDER
(i) The applications are allowed.
ii) Applicants be released on bail, on furnishing PB and SB of Rs.50,000/- each with one solvent surety of the like amount, in C.R.No.0199/2021 registered with the Police Station, Sirsala, Tq. Parali (V), Dist. Beed, for the offence punishable under sections 302, 201, 120B, 323 of the Indian Penal Code on the
condition that they shall not tamper with the prosecution witnesses.
