The learned counsel for the applicant wife, on instructions, submits that the petition be allowed to be withdrawn since respondent husband is intending to withdraw the proceeding before Family Court Dhule, which is sought to be transferred in the instant petition.

It appears that on last date the learned counsel for respondent husband had also fled certifed copy of pursis fled by the respondent in Family Court Dhule for withdrawal of the said proceeding. It was also pointed out by the learned counsel for the respondent that Family Court Dhule is not taking any steps for withdrawal since there is stay granted by this court to the said proceeding.

In view of the same and the statement made by the learned counsel for the applicant, the application stands withdrawn and disposed of alongwith the interim order of stay. ( SANDIPKUMAR C. MORE, J. ) VS Maind/-
