This is an application for modification of order dated 16th February 2021 passed by this Court in Bail Application No. 71/2021. 2.

The applicant was granted bail by this Court in Crime No. 326/2020 registered with Karmad Police Station, District Aurangabad for the offences punishable under sections 302, 201, 109 of Indian Penal Code.

The applicant was directed to be released on bail on executing PR bond in the sum of Rs.30,000/- with two solvent sureties of Rs.15,000/- each.

Learned counsel for the applicant submits that the applicant was arrested on 18.9.2020. Although she was granted bail by order dated 16th February, 2021, she has continued to be in the

Cri. Appln.No.3142/21 custody. She is not in a position to furnish two solvent sureties of Rs.15,000/-, each. It is submitted that the applicant be directed to be released on execution of PR bond in the sum of Rs.30,000/- with one surety in the like amount.

Learned APP submitted that the applicant is required to furnish the details of her place of residence to the Court while executing the bail bond.

Considering the fact that the applicant is languishing in custody inspite of bail being granted, the order dated 16.2.2021 in Bail Application No. 71/2021 can be modified.

Hence, order dated 16.2.2021 passed in Bail Application No. 71/2021 is modified by directing that the applicant be released on bail on executing PR bond in the sum of Rs.30,000/- with one surety in the like amount. The other conditions to continue. The application is disposed of.
