Heard the learned counsel for the applicants and the learned APP for the respondents-State.

The applicants are apprehending arrest in connection with Crime No. 765/2024 dated 15.09.2024 registered with Shevgaon Police Station, District Ahmednagar for the offences punishable under sections 118(2), 115(2), 352, 351(2), 351(3), 3(5) of B.N.S., 2023. 3.

The case against the applicants is that on 14.9.2024, the applicants along with their father have assaulted the informant and his wife. It is stated that applicant - Pradeep Harishchandra Garad has assaulted the informant on his left elbow with handle of axe whereas applicant Jaideep Harishchandra Garad has assaulted the informant on his lower left leg with stick.

Today, the learned APP has produced the injury certificate of the informant which shows that informant has sustained grievous injury on the lower left leg and on left elbow. The injury certificate shows that corresponding injuries are caused to the informant as alleged. The injuries are also grievous in nature.

In view of the above, no case is made out for grant of anticipatory bail. The application is dismissed.

It is clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
