The applicant prays for an out of turn final hearing of Second Appeal No. 677 of 2012 in the light of the order dated 28-01-2013 passed by this Court by which substantial questions of law were framed and the Second Appeal was posted for final hearing on 13-02-2013.

Since Second appeals instituted in the year 1985-86 and from 1989 onwards are pending final hearing and which are listed on every Thursday, precedence at this stage cannot be given to this Second Appeal.

As such, this Civil Application is rejected. However, in view of the order passed by this Court dated 28-01-2013, the applicant may renew his request after six months.
