Heard. The petitioner claims to be Vice President/ Chairman of the Murudeshwar Devsthan Trust. According to him, the respondent No.6 claims to be Chairman of the very Trust and has dealt with movable and immovable properties of the Trust, unauthorisedly. Our attention has also been drawn to the observations made by the learned Assistant Charity Commissioner in this regard. It is, however, informed that, three Change Reports are pending enquiry before the concerned Assistant Charity Commissioner.

Our attention has also been adverted to the minutes of the meeting presided over by the Sub-Divisional Officer, wherein an accusing finger has been made against respondent No.6. The petitioner may have a good case, but he has equally efficacious remedy in the nature of approaching the Court of Judicial Magistrate, First Class and seek remedy under Section 156(3) of the Code of Criminal Procedure.

With the above observations, the petition stands disposed of. Such application would be decided by the concerned Magistrate on its own merits.
