Learned counsel for the petitioner, after arguing the matter for some time, states that the application filed by petitionerdefendant was made under an incorrect assumption and incorrect legal advice and the petitioner would apply the learned Civil Judge to withdraw the application keeping open the issue regarding burden and seeks leave to withdraw the petition. If such an application is made, the learned Civil Judge to consider the same on its own merit after giving an opportunity to the respondent-plaintiff.
