Dixit, Advocate for Applicants, Learned counsel for applicants submits that the First Appellate Court has confirmed the decree passed by the Trial Court but has modified the shares. Hence, according to him, decree passed by the First Appellate Court ought to be executed and not the decree passed by the Trial Court.

This Court finds substance in his contention that the Execution Court cannot be permitted to proceed with the execution. Hence, till the next date of hearing, there shall be stay to the execution of the proceedings.
