The learned A. G. P. and Mr. Dighe, the learned counsel raise a preliminary objection that, there is remedy provided U/Sec. 6 and 7 of the Maharashtra Restoration of Lands to the Scheduled Tribes Act 1974.

In the light of that, though Mr. Shirsat the learned counsel for the petitioner has sought to canvass submissions on merits of the matter, we are not inclined to consider the same. The writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. All contentions of respective parties are kept
2 wp 11521.14 open. The authority where the proceedings would be filed, shall consider the time spent in prosecuting the present writ petition. No costs.
