Maharudra Machindra Paraskar v. The State Of Maharashtra
( 1 ) 912 ba 1666.21
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 912 BAIL APPLICATION NO.1666 OF 2021 MAHARUDRA MACHINDRA PARASKAR
VERSUS
THE STATE OF MAHARASHTRA ...
Advocate for Applicant : Mr. Hange Rajendra G. APP for Respondents/State : Mr. S.B. Narwade ...
CORAM : M.G. SEWLIKAR, J.
DATE : 27th January, 2022 P.C.:- Applicant has filed this application under Section 439 of the Cr.P.C. for releasing him on bail.
2.
Without going into the factual aspects of the case, this application can be disposed of as it appears that the learned trial Court has not decided the application and kept it pending for orders. Learned counsel Shri Hange invited attention of this Court to para 10 of the order dated 19th November, 2021 passed by Additional Sessions Judge, Beed. Since it is a short para, I deem it appropriate to quote it in verbatim:
"10.
In these circumstances, I am not inclined to exercise discretion of regular bail in favour of accused Maharudra. Of course, at the same time, one barrier is kept on the prosecution to speed-up the trial. I hold that the case should reach at the stage of
( 2 ) 912 ba 1666.21 examination of accused under Sec.313 of CrPC by the end of October' 2022. Dates in this case should be given as per the choice of Ld. Prosecutor. If prosecution fails to accomplish this exercise successfully in time, this bail application would be allowed at said moment. Keep this application pending for order."
3.
It appears that the learned trial Court has not passed any order on this application. Learned Additional Sessions Judge, Beed has kept it pending for order. It seems that order is still not passed. Learned Additional Sessions Judge is directed to decide the application for bail below Exhibit-10 in Sessions Case No.58/2021 (State V/s. Maharudra) within eight days from the date of receipt of the writ. With these directions, application is disposed of. [M.G. SEWLIKAR, J.] mub
