Heard Mr. Bhosle, learned counsel for the petitioner and Mr Wagh, learned counsel for respondent no.1. 2.

By way of present petition, the petitioner is challenging the order passed by the learned Joint Civil Judge, Senior Division, Sangamner dated 19.11.2021 in Regular Civil Suit No.1100 of 2016, whereby the application below Exhibit-40 came to be rejected. 3.

Learned counsel for the petitioner submits that there is no dispute regarding four boundaries. The petitioner only wants to add Survey No.66/3/8 and there is no change in suit property. 4.

I have considered the rival submissions advanced by both the counsels and after going through the order passed by the learned Trial Court, it reveals that the Trial Court while rejecting the application has observed that after leading the evidence, now the suit

11-wp-724-2022.odt (2) was kept for final arguments and therefore, at the belated stage, the said application was not considered. After going through the order and documents placed on record, I do not find any perversity in the order passed by the learned Joint Civil Judge, Senior Division, Sangamner dated 19.11.2021 in Regular Civil Suit No.1100 of 2016. 5.

Hence, the writ petition stands dismissed.
