By the present application, the delay in filing the review petition against the order passed by this Court on 17.10.2019 is sought to be condoned.

On hearing the learned Counsel for the applicant and on perusal of the application, it appear that though the writ petition was disposed off by this Court on 17.10.2019, the Special Leave Petition came to be filed before the Hon'ble Supreme Court and by order dated 22.09.2021, the Spl. Leave Petition came to be disposed off with liberty to the petitioners to approach the High Court by way of appropriate review petition to recall the order which was passed exparte and a direction was issued to the effect that it shall be considered on merits at the earliest.

Upon the order being passed on 22.09.2021, the review petition has been filed and along with it, a delay of 120 is sought to be condoned. The said delay is explained in paragraph no. 5 of the

3 908 said application and the same is justified to be procedural one in obtaining the necessary papers.

In the wake of the liberty granted by the Hon'ble Apex Court in filing the review petition, I am convinced with the reasons stated in paragraph nos. 5 and 6 of the application. Necessarily the Civil Application No. 1069 of 2022 is allowed by condoning the delay of 120 days.

Registry is directed to register the review petition. CIVIL APPLICATION NO. 1068 OF 2022 :

Issue notice to the respondents on Civil Application No. 1068 of 2022 by which the stay is prayed. Similarly, the notice is also issued on the review petition, which is directed to be registered on condonation of delay. Notice is made returnable on 10 th March, 2022. Hamdast granted.
