This is an application for transmitting the amount deposited by appellant before this Court to the executing Court.

Heard learned counsel appearing for the parties. The first appeal is already dismissed by this Court. As such, the amount deposited in this Court needs to be transmitted to the Executing Court i.e. Joint Civil Judge, Senior Division, Ahmednagar whether the executing proceeding (R.D. No.88/2010) is pending. Hence application is allowed in terms of prayer clause (B). 3.
