Heard learned counsel for the applicant, learned APP for the State and learned counsel for the victim/respondent no.2. 2.

It appears that at the time of the alleged incident, the victim was above 17 years old. The allegations of blackmailing her on the basis of taking her indecent photographs is not corroborated with any photograph. It has been alleged that the applicant sent her indecent photographs to her uncle. However, no such photographs were found in his mobile handset. No indecent photographs were found in the mobile handset of the accused. It appears that the victim had voluntary relationship with the accused. She voluntarily went to one lodge with him. It appears that when their relationship came to the light, the report has been lodged. The victim was able to know the acts of the consequences. Threatening the victim by the parents

935-ba-1983-2022.odt (2) cannot be ruled out. The consensual relationship also appears possible. The investigation has been completed. Nothing remained to be recovered from the applicant. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Pradip Chhaban Chattar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.596 of 2022, registered at Parner Police Station, District Ahmednagar for the offence punishable under Section 376(2)(n), 376(2)(f), 354(C), 354(D), 506 of the Indian Penal Code and Section 4, 6 and 12 of Protection of Children From Sexual Offences Act, on the conditions that;

(a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall not contact the victim in any way, till conclusion of the trial.
