The applicant herein was convicted for the offence punishable under Sections 279, 304(A) and 337 of the Indian Penal Code and sentenced to suffer R. I. for period of one month for the offence punishable under Section 279 of the Indian Penal code and further sentenced to suffer R.I. for period of six months and to pay fine of Rs. 500/- (Rs. Five Hundred only), in default to suffer R.I. for 8 days, for offence punishable under Section 304(A) of the Indian Penal Code and further to suffer R.I. for 3 months, for offence punishable under Section 337 of the Indian Penal Code.

The appeal against the said conviction is dismissed. 3.

It is not in dispute that, the applicant was on bail before the trial Court and appellate Court.

In view of above, it will be appropriate to suspend the sentence.

The substantive sentence is suspended and the applicant is admitted on bail, on the same terms and conditions, as were ordered by the learned Court below.

Criminal Application stands disposed of.
