Heard the learned Counsel appearing for the respective parties. It is brought to my notice that, previously this Court (Coram : Sunil P. Deshmukh, J.) vide order passed on 27.04.2018 has permitted the withdrawal of the amount by the other claimants. The applicant has prayed for permitting him to withdraw the amount on the said terms.

In view of the submissions made, the following order is passed.

ORDER

(i) The applicant is permitted to withdraw 50% of the deposited amount with interest accrued thereon, falling to his share, on submitting an undertaking to the satisfaction of the

(ii) Balance 50% amount of his share be invested in Fixed Deposit Receipt in any Nationalized Bank for the period till disposal of the appeal.

(iii) Civil Application stands disposed of.
