1] The learned counsel for the petitioners submits that substantial delay in filing suit has not been considered. 2] However, the delay is a mixed question of facts and law and the same would be considered at the stage of trial, so also, the trial Court by impugned order dated 04.09.2025 rejected the application of the petitioners holding that there is no provision under the Watans Abolition Act excluding daughters as heirs and that the question of prior partition would be decided at trial. Considering the same, no case is made out for interference. Hence, the Writ Petition is dismissed.
