Heard the learned Advocates for the respective sides who have appeared in the matter.

For the reasons set out in the application, same is allowed. Learned Advocates for the respondents prays for costs, which be donated to the Advocate Associations' Bar Library, High Court, Aurangabad.

The delay of 919 days is condoned by imposing costs of Rs.3,000/- which shall be deposited with the Advocate Associations' Bar Library, High Court, Aurangabad on or before 15/01/2018, khs/DEC. 2017/17968

failing which, this order shall stand recalled and the abatement order shall stand restored.
