The undisputed facts of the case are that respondent is working as a peon in the Social Welfare Department of the State of Maharashtra from 1996 continuously and uninterruptedly. The Industrial Court by order dated 8.7.2024 has observed that there are various Government Resolutions issued by the State Government for regularization of the services of the temporary employees and has directed the petitioner to send proposal for regularization of the services of the respondent to the State Government. It is also not disputed that there are 4-5 posts under the control of petitioner and on one of these posts, the respondent is working as a peon from 1996 to till date.

From perusal of the record, it appears that till date no advertisement is published even after order passed by Maharashtra Administrative Tribunal on 26.8.2009 and thereafter the Industrial Court has directed the petitioner to send the proposal for regularization of the services of the respondent to the State Government on 8.7.2024. The respondent is

WP 13785/25 working on the post of peon in the Social Welfare Department for last 29 years without formal advertisement of that post. Considering the above facts, the direction issued by the Industrial Court cannot be faulted with. Considering the same, I see no error in the directions issued by the Industrial Court. Hence, the writ petition is dismissed accordingly. ( ARUN R. PEDNEKER, J. ) ssc/
