Inspite of service, none appears of the respondent. This application is by the wife seeking transfer of matrimonial proceeding bearing No.A/1781/2024, pending in the Court of learned Judge, Family Court, Pune (Court No.9) to the Court of learned Judge, Family Court, Latur.

It is case of the wife in this application that she has filed proceeding for maintenance in the Court at Latur bearing No. E-98/2024. It is after getting notice in the said proceeding the husband has filed proceeding in the Court at Pune, under section 9 of the Hindu Marriage Act for restitution and conjugal rights. There is one more proceeding pending in the Court at Latur, wherein the wife has prayed for putting charge on the property of in-laws. It is submitted that the husband has already appeared in the proceeding for maintenance. 03.
It is stated that the wife is staying with her child of 2 1⁄2 years of age. There is no one to accompany her as she is residing with

Considering that inspite of notice, none appeared for the respondent and for the facts stated above, this Court is inclined to allow this application.

This application is, therefore, allowed in terms of prayer clause (B). In the Trial Court, the wife shall not seek unnecessary adjournments. If the Trial Court finds that the wife is seeking unnecessary adjournments, the Trial Court shall pass appropriate orders compensating the husband if he personally remains present in the Court.
