The learned counsel for the petitioner submits that, the application under Section 28-A of the Land Acquisition Act is pending with respondent no.2.

In case, application is filed by the petitioner under Section 28-A of the Land Acquisition Act and if the same is pending before respondent no.2, then respondent no.2 shall take decision upon it on its own merits, in accordance with law, after hearing all parties concerned, expeditiously and preferably within a period of nine (09) months.

Writ Petition is disposed of. No costs.
