By this petition the petitioner seeks writ of hebeas corpus for production of his uncle Sanjay S/o Bhaskar Shirsat before this Court contending that he is in the custody of Respondent no.2 - Police Inspector, City Chowk Police Station, Chhatrapati Sambhajinaar. 2.

Respondent No.2 Mr.D.M. Chandan, API, City Chowk Police Station is present in the Court and he has submitted a report that uncle of the petitioner was sitting on hunger strike, his health deteriorated. Therefore, as per the opinion of the Civil Surgeon, he was admitted in GHATI Hospital. Presently, he is taking treatment in GHATI hospital and he is not in custody of respondent no.2. Since uncle of the petitioner is admitted in GHATI hospital, it is not possible for respondent no.2 to produce him before the Court. 3.

Learned advocate for the petitioner further submits that he intends to admit his uncle in private hospital for better treatment. Uncle of the petitioner may be discharged by recording his undertaking
