Heard. Perused the orders impugned herein, particularly Clause II in order dated 15th September, 2020 directing the petitioners herein to deposit Rs.20,000/- each with the Court of J.M.F.C. as a cash security pending conclusion of the trial.

From perusal of the order granting bail it is not clear as to why the petitioners herein have been directed to deposit some amount as cash security. Another order passed by the very Court in respect of the co-accused has been placed on record, wherein no such direction has been imposed. The petitioners have already been granted bail.

Since it is not clear as to why the petitioners are directed to deposit a sum of Rs.20,000/- each while similarly placed co-accused has not been imposed with such condition, writ petition deserves to be allowed. It however appears that in prayer clause (B) the petitioners are ready to deposit Rs.5,000/- each towards security. Order dated 15th September, 2020 impugned herein is, therefore, modified in terms of prayer clause (B). Writ petition stands disposed of accordingly.
