Heard learned counsel for the parties.

Challenge in this petition is to the refusal of the approval to her appointment on compassionate ground by the respondent - Education Officer.

The learned counsel for the petitioner states that there are vacant posts available in the school and he has pointed out that there are representations as referred to in prayer clause 'B' which are made to the respondent - Education Officer but the same are SG Punde

964WP14419.2021.odt -2undecided. It is submitted that approval is granted to some other employees i.e. respondent nos. 7 and 8.

After hearing learned counsel for the parties, we find that it would be appropriate for respondent - Education Officer to decide the representations on their own merits and after calling such information from the respondent-management, as may be necessary. It would be open to the respondent - Education Officer to hear the parties and decide the representations in the light of the earlier order dated 20.03.2019 passed in Writ Petition No. 7860/2018 and, in particular, the letter dated 09.02.2017, within a period of two (02) months from the receipt thereof. Ordered accordingly.
