At the outset learned counsel for the petitioner seeks leave to amend the prayer clause 'A'. Leave granted. Amendment to be carried forthwith.

These petitions are filed by the petitioners taking exception to orders passed below Exhibit A-16 and A-17 in appeal bearing No. KBCNMU-01 of 2022 and KBCNMU-02 of 2022. By order passed below Exh. A-16 and A-17 in both appeals the learned University and College, Tribunal, Aurangabad has refused to stay the order of termination. Whereas by orders are below Exh. A-1, observations were made with regard to the adjudication of those appeals.

Learned counsel for the petitioners state that the interest of justice would be made if the learned Tribunal is directed to decide both the appeals expeditiously. He further makes statement about not pressing the relief in this petition to the extent of orders passed below Exh. A-16 and Exh.A-17. However, since setting aside of order passed below Exh. A-1. Learned counsel for the contesting respondent Nos. 1, 2 and 3 has recorded no objection for setting aside orders passed below Exh. A-1. Thus, by consent by both sides impugned orders dated 4th July, 2022 passed below Exh. A-1 in appeal bearing No. KBCNMU-01 of 2022 and KBCNMU-02 of 2022 are hereby set aside.

Learned Tribunal to decide the appeal expeditiously. Both sides are directed to cooperate in expeditious disposal of the appeal. They are further directed to appear before the learned Tribunal on 13th March, 2023.
