These are the applications for condonation of delay moved by the applicants.
Heard Mr. Tripathi, learned counsel for applicants and Mrs. Jape, learned AGP for respondent Nos.1 and 2. None present for respondent No.3/acquiring body when the matters are called out. In this group of civil applications, there seems to be delay ranging from 411 days to 435 days in preferring the appeals. For the reasons stated in the applications for condonation of delay paragraphs 2 to 4 and looking to the grounds involved in the appeals, the delay needs to be condoned, however, on condition that the applicants shall not be entitled to claim the statutory benefits and interest in respect of the delayed period. Hence, the following order is passed:
O R D E R
I.
The civil applications for condonation of delay are hereby allowed in terms of prayer clause (B) on condition that the applicants/original claimants shall furnish usual undertakings with the Registrar (Judicial) of this Court stating that they shall not claim statutory benefits and interest in respect of the delayed period, which is condoned today.
II.
After furnishing such undertakings with the Registry, the appeals be registered after due scrutiny as per procedure and they be numbered and place before the Court for admission.
III.
The civil applications for condonation of delay are accordingly disposed of.
