The application filed by the present petitioner purportedly under Section 340 of Cr. P. C. is rejected. In view of Section 341(1) of the Cr. P. C. remedy is provided against said order in an appeal before the superior Court. It would also be worthwhile to refer that, in the order it is observed that, the same claim raised by the instant application was raised in application Exh. 32 and

33. The same claim was rejected even in writ petition No. 8527 of 2011 vide order dated 01.08.2013.

Considering the above, the present criminal writ petition is not tenable as such, is dismissed.

In case, the petitioner has any remedy, the petitioner may prosecute the same.
