PER COURT :

We have heard learned counsel for petitioner, Mr.Bade Patil, learned counsel for committee and learned AGP for employer. The case of the petitioner to direct the respondent to extend protection of service without insisting for the validation proceeding, cannot be considered in view of the judgment of Full Bench of this Court in the case of Arun Sonune Versus State of Maharashtra and others reported in 2015 (1) MLJ 457.

2] The petitioner is at liberty to submit the documents to the committee. The Committee shall decide the said validation proceeding on its own merits.

3] Till the validation proceedings are decided, the respondent-

{2} wp11494-14.odt employer shall not take adverse action against the petitioner only on the ground that validation proceedings are pending. 4] Writ Petition is accordingly disposed of. No costs. The petitioner is at liberty to approach this Court in the event some adverse orders are passed against the petitioner against the validation proceeding.
