Against the judgment of the Family Court refusing to grant relief of divorce, the present Family Court Appeal is filed before this Court which is delayed by 324 days.

The delay is sought to be condoned by disclosing the reasons in the application which are objected by the learned counsel for the respondent - wife, as according to him, the delay is not properly explained.

There appears to be delay of around 10 months in preferring the appeal.

For the reasons disclosed in the application and subject

to payment of costs of Rs.3,000/- to be paid to the respondent within a period of two weeks, the application is allowed. Delay is condoned. Civil Application stands disposed of.
