Heard the learned counsel for the applicant, learned APP for the respondent-State and learned counsel for the victim.

It is the case of contract to live-in relationship on payment for the purpose to procure child. The applicant has been arraigned as an accused. The papers reveal a written agreement. The victim/prosecutrix has received the money for living in relationship with the applicant. After six months, they had some dispute and the victim lodged the report. The papers reveal that she was living with the applicant with consensus. During the period of her stay, she never complained against the

39-BA.1997-22+1.odt applicant. Now, she came with the case that she has no objection to grant bail to the applicant. As far as the antecedents to the discredit of the applicant, those are not related to the sexual offences. Considering the facts of the case, it would be inappropriate to keep the applicant behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant AMIT RAM ZENDE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.185 of 2022, registered by Police Station Anandnagar, District Osmanabad, for the offence punishable under Sections 376(2(n), 307, 324, 323, 504, 506 read with Section 34 of the IPC, on the condition not to tamper with the prosecution witnesses.

(iii) Criminal application No.4334 of 2022 to assist the learned APP is allowed.
