This is an application for regular bail in Crime No.111 of 2014 registered at Gondi Police Station, Taluka Ambad, District Jalna for the offences punishable under Sections 307, 395, 324 and 323 of the Indian Penal Code and Section 4 read with 25 of the Indian Arms Act.

Heard Mr. N. B. Jadhav, learned counsel for Applicant and Mrs. M. A. Deshpande, learned APP for State. Perused papers of investigation.

Chandrakant Abhimanyu Kale resident of Bhardi, Taluka Ambad, District Jalna is the first informant. On 6th June, 2014 he lodged report against Applicant and other co-Accused. It can be seen

from FIR that dispute has arisen between the parties on agricultural land. It is alleged that there were attacks and counter attacks between the family members.

Co-Accused have been enlarged on bail by this Court vide order dated 3rd December, 2014 in Criminal Application Nos.5894 and 5897 of 2014. Role attributed to Applicant is of lesser gratitude than to co-Accused Shivnath who has been enlarged on bail. Considering the fact that there were counter complaints, Accused to whom main role is attributed has been released on bail and dispute on the landed property between the family members this Court is inclined to allow the application. Hence the following order -

O R D E R

I.

Criminal Application No.6171 of 2015 is allowed. II.

Applicant is released on bail in Crime No.111 of 2014 registered at Gondi Police Station, Taluka Ambad, District Jalna for the offences punishable under Sections 307, 395, 324 and 323 of the Indian Penal Code and Section 4 read with 25 of

the Indian Arms Act, on P.R. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand only) each.

III.

Applicant shall not tamper with the prosecution evidence and shall make himself available as and when required.

IV.

Bail before the Trial Court.
