Heard learned counsel for the applicants and respondents. 2.

Perused the application. This is an application for condonation of 58 days delay caused in filing the appeal against impugned judgment and Award passed by the Commissioner for Employees Compensation Act and Judge, Labour Court Latur. It has been submitted that the delay caused in filing the appeal is not intentional or deliberate, but it caused due to unavoidable circumstances.

Considering the reasons mentioned in the application, there is no impediment to condone the delay. Hence, the application stands allowed in terms of prayer clause "B". The delay caused in filing the appeal against impugned judgment and Award dated 30-06-2016 passed by Judge, Labour Court, in WAC No. 10 of 2015 is hereby condoned. The Registry to take requisite steps for registration of appeal. The civil application stands disposed of accordingly.

On registration of appeal, issue notice to respondents. Mr. Marlapalle, learned counsel waives service of notice for respondents. 5.
