By filing the present petition, the petitioner has disputed the order passed by the 5th Joint Civil Judge, Senior Division, Jalgaon, on 3.9.2015 below Exh.54 in Special Civil Suit No.172/2013. Vide the impugned order, the learned trial Court has allowed impleadment of the Jalgaon Peoples Cooperative Bank Ltd., Jalgaon, as defendant no.3 in the suit. According to the petitioners, the order so passed is unjust and there was no reason for impleadment of Jalgaon Peoples Cooperative Bank Ltd., Jalgaon, as party defendant. It is the further contention in the petition that, with the only intention of spoiling the image of the present petitioner, the said application was filed by the original plaintiff.

2) When the present matter is taken up for hearing, Shri Talhar, learned Counsel appearing for the petitioner submits that, the petitioner is giving up the challenge raised in the present - agp/-

Shri Wani, the learned Counsel appearing for the respondents submits that, the respondents do not have any objection for passing such order. In view of the submission so made, the following order:

ORDER

a) The writ petition stands dismissed. The learned trial Court is however directed to hear and decide the Special Civil Suit No.172/2013 as expeditiously as possible, preferably within the period of one year from the date of receipt of writ. ( P.R. BORA, J. ) ...
