By way of this application, applicant i.e. original accused is seeking condonation of delay of 1 years 5 months and 19 days in filing the present appeal. Though the application is strongly opposed by the learned APP, but considering the fact that applicant has been convicted for the offence under Section 302 of IPC, the application stands allowed in terms of prayer clause-B and the aforesaid delay stands condoned.
