Heard the learned counsel for the applicant and the learned APP for the State.

The present applicants are acquitted for an offence punishable under section 302 of the Indian Penal Code, however, they have been convicted for the offence punishable under section 324 of Indian Penal Code and have been sentenced to suffer R.I. For three years. Sentence is a short sentence. Said sentence is also suspended by the Sessions Court. Evidence will be required to be re-appreciated. It may not be possible to hear the appeal within a short time. Inconsistencies in the evidence are pointed out.

Considering the above, sentence is suspended. The present applicants are released on same bail fresh bonds. 4.

Application accordingly disposed of.
