This pertains to the personal injury sustained by the applicant during the course of his employment. It appears that there is amputation of the right thumb. Though learned counsel for the respondent-insurer has strongly resisted the application seeking withdrawal, however, considering the defence raised by the respondent-insurer and the findings recorded by the learned Commissioner for Employees' Compensation and Judge, 2nd Labour Court, Ahmednagar, vre/-

37-CA-2911-2020.odt the applicant is hereby permitted to withdraw 50% of the amount out of the amount deposited before the Commissioner for Employees' Compensation and Judge, 2nd Labour Court, Ahmednagar, on furnishing undertaking to the satisfaction of the learned Commissioner. The Civil Application is accordingly disposed off.
