During the course of hearing, a query was made to learned counsel for the Petitioner as to whether there is specific pleading in application Exhibit 81 about the correct stamp duty applicable to the document in question.

Learned counsel for the Petitioner, on going through the said application submits that it seems that there is no such objection raised.

This Court, therefore, does not wish to grant any relief to the Petitioner.

Learned counsel for the Petitioner, on instructions, seeks withdrawal of the Petition with liberty to file appropriate application before the Trial Court.
