PER COURT :- 1.

The petitioners are aggrieved by the order dated 28.8.2019, by which, the Revision Application filed by respondent No.5 has been allowed by the Honourable Minister. His appeal before the Joint Registrar, Cooperative Societies, Nasik Division, Nasik is still pending and the Honourable Minister granted him protection during the pendency of the said appeal, which was refused by the said appellate authority.

Though the learned Advocate for the petitioners has strenuously canvassed the eleven grounds formulated in the memo of the petition, I find that this petition need not be entertained for the following reasons.

(a) Both the petitioners are intervenors before the appellate akl/d

BENCH AT AURANGABAD 2- WRIT PETITION NO.13774 OF 2019 authority / respondent No.2 and their applications for intervention are still undecided.

(b) The Honourable Minister has granted interim protection to respondent No.5 and has directed respondent No.2 to decide pending appeal No.31 of 2019 within two months.

(c) The appeal is pending and can be decided expeditiously. 3.

In view of the above, this petition is disposed off. As the appeal is expedited, the petitioners are at liberty to request respondent No.2 to decide their intervention applications before deciding the said appeal, expeditiously. Respondent No.2 would thereafter decide the pending appeal within the extended period of time and if no such order of extension is received by respondent No.2, it shall endeavour to decide the said appeal on/or before 31.1.2020.
