The applicant herein has been convicted for the offence punishable under Sections 304-II and 323 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for five years and fine of Rs.25,500/-, in default to suffer simple imprisonment of six months. It is informed that the amount of fine has already been deposited.

The applicant had been on bail during the trial except initial period of six months. The criminal role attributed to him is pelting stone 1 / 2

In the factual backdrop, the execution of substantive sentence of imprisonment stands suspended pending the appeal. The applicant be released on his executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety in the like amount. 5.
