Heard learned counsel for the applicant. The respondent despite service remained absent.

The applicant is claiming transfer of Marriage Petition No.1136/2022 filed by the respondent -husband for getting divorce, from the Court of learned XXII Jt. Civil Judge, Senior Division, Pune to the Court of learned Civil Judge, Senior Division, Latur. 2.

It appears that applicant is not having any source of income. Moreover, the distance between Latur and Pune is of 400 kms. Further there are two proceedings going on at Latur against the respondent, one is criminal prosecution under Section 498-A of the Indian Penal Code and another is proceeding under Protection of Women from Domestic Violence Act, 2005. As such, the respondent -

husband will have to attend the dates at Latur anyhow, in future. As such, considering the convenience of the applicant, following order is passed :

ORDER

(i) The application is allowed.

(ii) Marriage Petition No.1136/2022 is hereby transferred from learned XXII Jt. Civil Judge, Senior Division, Pune to the Court of learned Civil Judge, Senior Division, Latur, for disposal according to law.

(iii) The respondent is directed to appear before the Civil Judge, Senior Division, Latur, on or before 01.03.2023. (iv) The application is accordingly disposed of. (SANDIPKUMAR C. MORE) JUDGE .....
